These Terms of Service (the “Terms”) set forth the terms and conditions governing the use of “Mintsuku – The Community-Built Collection Encyclopedia” (the “Service”).
All users of the Service must review and agree to these Terms before using the Service.
Article 1 (Application)
- These Terms apply to all matters between the operator and users relating to the provision and use of the Service.
- Rules, notices, guidelines, and other provisions posted within the Service or on the Service’s official website form part of these Terms.
- If any individual rule or guideline conflicts with these Terms, these Terms will prevail unless otherwise expressly stated in the applicable individual rule or guideline.
Article 2 (Service Description)
The Service is a community-built encyclopedia and collection management service that allows users to register, share, view, and manage information relating to athletes, teams, trading cards, merchandise, collectibles, and other collection items.
The Service may provide features including:
- Viewing player and team data for MLB, NBA, and other sports supported by the Service
- Registering, viewing, and managing trading cards and personal collections
- Registering, viewing, and managing merchandise, collectibles, and other collection items associated with players and teams
- Registering and sharing item images, comments, trivia, and other information
- Recording that a user also owns an item registered by another user
- My Collection and profile features
- Likes, reporting, and other community features
- Viewing sports-related data, including player, team, game, and ranking information
- AI Reference Appraisal and other AI-assisted features
- Features available according to free and paid plans
- Other features provided by the operator through the Service
The content of the Service, supported sports, available data, and individual features may be added, modified, suspended, or discontinued.
Article 3 (Accounts)
- An account or authentication may be required to use certain features of the Service.
- Users must provide information that is as accurate and up to date as reasonably possible when registering information with the Service.
- Users are responsible for properly managing their own accounts.
- Users must not permit unauthorized third parties to use their accounts.
- If unauthorized account use or another security issue is identified, the operator may take measures necessary to protect the Service, including restricting functionality, hiding submitted content, or suspending the account.
Article 4 (Registered and Submitted Content)
- Information, images, comments, trivia, and other content relating to cards, merchandise, collectibles, and other collection items registered or submitted by users may be made visible to other users depending on the functionality of the Service.
- Users are responsible for the content they register or submit.
- Because the Service is a community-built encyclopedia, information about an item registered by one user may be shared with or referenced by other users who own the same item.
- Users must, to the extent reasonably possible, provide accurate information regarding an item’s season, year, brand, series, card number, variant, category, item name, and other identifiable information.
- Registered information may be used for identifying matching items, search, collection management, AI Reference Appraisal, and other Service features.
- Users must not register or submit content that:
- Is false or materially misleading
- Infringes another person’s copyright, trademark rights, portrait rights, privacy rights, or other rights
- Violates applicable laws or public order and morals
- Contains personal information that should not be made public, such as a real name, postal address, telephone number, or email address
- Defames, harasses, or otherwise harms another user or third party
- Is intended to interfere with operation of the Service
- Is otherwise determined by the operator to be inappropriate
Article 5 (Rights in User Content)
- Copyright and other rights in content registered or submitted by users remain with the user or other lawful rights holder, as applicable.
- By registering or submitting content to the Service, the user represents that they possess the rights or permissions necessary to allow that content to be used through the Service.
- Users grant the operator a royalty-free right to use registered or submitted content to the extent necessary to provide, display, operate, improve, promote, protect, and moderate the Service and prevent abuse.
- The license described above does not prevent users from using their own content for other purposes.
Article 6 (Correction, Hiding, and Deletion of Information)
- Because the Service is a community-built encyclopedia, registered information may be subject to reports, correction requests, or other information submitted by other users.
- If the operator determines that registered information is inaccurate, inappropriate, potentially infringing, or harmful to the quality or safety of the Service, the operator may take measures including:
- Correcting information or images
- Changing representative images or other displayed content
- Hiding content
- Deleting images or other data
- Organizing or adjusting ownership information and related data
- Taking other measures necessary for proper operation of the Service
- Even if a user deletes submitted content or ownership information, shared item information may remain available if another user has a legitimate registration or ownership record for the same item.
- Deleted information or related historical records may be retained for a certain period where necessary for system security, data integrity, abuse prevention, auditing, backups, or other legitimate purposes.
Article 7 (AI Reference Appraisal)
- The Service may provide an AI-powered reference appraisal feature for cards, merchandise, collectibles, and other collection items registered by users.
- AI Reference Appraisal results are reference information generated based on item information registered by the user, AI-based identification and estimation, market information, and other available information.
- AI Reference Appraisal does not constitute authentication, a formal valuation, a purchase offer, solicitation to buy or sell, or a guarantee of any particular transaction price.
- AI Reference Appraisal values may differ significantly from actual market or transaction prices due to incomplete or incorrect registered information, AI misidentification, item condition, market conditions, currency exchange fluctuations, transaction region, and other factors.
- Users must use AI Reference Appraisal results solely as reference information and at their own judgment and responsibility.
- The operator does not guarantee the accuracy, completeness, usefulness, specific market price, transaction price, or future value of any AI Reference Appraisal result.
- AI Reference Appraisal may be performed multiple times, and the Service may retain and display previous appraisal results as appraisal history.
- AI Reference Appraisal may display reference values in Japanese yen, U.S. dollars, or other currencies supported by the Service. Where currency exchange rates are used, they may differ from actual payment or currency exchange rates.
- Conditions applicable to AI Reference Appraisal, including usage limits, advertising requirements, and the number of items that may be appraised in a batch, may differ according to the user’s free or paid plan and other usage conditions.
Article 8 (Prohibited Conduct)
Users must not engage in any of the following conduct when using the Service:
- Conduct that violates applicable laws or public order and morals
- Conduct that interferes with operation of the Service
- Unauthorized access or attempted unauthorized access
- Improperly bypassing the Service’s systems, APIs, authentication mechanisms, or other technical safeguards
- Spam, trolling, or other conduct that interferes with other users’ use of the Service
- Harassment, threats, defamation, or abuse directed at other users or third parties
- Impersonating another person
- Unauthorized use of another user’s account
- Intentionally registering ownership of items the user does not own for the purpose of disrupting or misleading the Service
- Intentionally submitting large amounts of false information
- Abusing reporting functions or other Service features for improper purposes
- Altering, falsifying, or improperly transmitting data for the purpose of manipulating AI Reference Appraisal results, rankings, or other displays
- Using the Service to deceive another person
- Unauthorized commercial use of the Service or its data
- Any other conduct the operator determines may threaten the safety or proper operation of the Service
Article 9 (Free Plans, Paid Plans, and Advertising)
- The Service may offer free and paid plans.
- Free plans may be subject to limits on the number of registrations, frequency of use, or other functionality.
- Certain features available to free users may require viewing rewarded advertisements or other advertisements.
- Paid plans may provide additional features such as removal of advertisements, expanded usage limits, or batch processing.
- Details of paid plans, including prices and available features, will be displayed within the Service or on the App Store.
- Payments, renewals, cancellations, and other billing-related transactions for paid plans are processed through the App Store provided by Apple Inc.
- After cancellation of a paid plan and expiration of the applicable subscription period, users may generally continue using the Service under the free plan, except where the Service itself is discontinued or other special circumstances apply.
Article 10 (External Services)
The Service may use external services including Firebase, Google Mobile Ads / AdMob, OpenAI / ChatGPT, and other providers for authentication, data storage, advertising, AI functionality, and other features.
Use of external services may also be subject to the terms of service, privacy policies, and other conditions established by the relevant service providers.
Certain Service features may become temporarily or permanently unavailable due to outages, specification changes, usage restrictions, discontinuation, or other circumstances affecting external services.
Article 11 (Changes, Suspension, or Discontinuation of the Service)
The operator may modify, suspend, or discontinue all or part of the Service where necessary, including in the following circumstances:
- System maintenance, updates, or incident response
- Outages, specification changes, or discontinuation of external services
- Natural disasters, communication failures, or other events beyond reasonable control
- Security incidents or risks
- Legal, regulatory, or operational necessity
Where reasonably possible, the operator will endeavor to provide advance notice. In urgent circumstances, changes, suspension, or discontinuation may occur without prior notice.
Article 12 (Usage Restrictions and Account Suspension)
If a user violates these Terms, threatens the safety or proper operation of the Service, or the operator otherwise determines that action is necessary, the operator may take measures without prior notice, including:
- Restricting registration or submission functionality
- Hiding or deleting content
- Suspending access to certain features
- Temporarily suspending or disabling an account
- Taking other measures reasonably necessary to protect the Service
Article 13 (Disclaimer)
- Information available through the Service regarding players, teams, cards, merchandise, games, rankings, trivia, and other matters may include user-submitted content, external data, and AI-generated information.
- The operator does not guarantee the accuracy, completeness, timeliness, usefulness, or other qualities of information available through the Service.
- Users use information available through the Service at their own judgment and responsibility.
- To the extent permitted by applicable law, the operator will not be liable for damages arising from use of, or inability to use, the Service.
- Disputes between users or between a user and a third party must generally be resolved between the parties involved. However, the operator may take measures reasonably necessary to protect the safety and proper operation of the Service.
Article 14 (Unofficial Service Disclaimer)
The Service is not an official service operated, provided, approved, endorsed, affiliated with, or sponsored by Major League Baseball (MLB), the National Basketball Association (NBA), any league, club, team, player, or other related party.
All names, trademarks, logos, and other rights belong to their respective owners.
Article 15 (Privacy)
The handling of user information through the Service is governed by the separately established Privacy Policy.
Article 16 (Changes to These Terms)
- The operator may revise these Terms as necessary due to changes in applicable laws, changes to the Service, or other circumstances.
- When material changes are made, the operator will endeavor to provide notice through the Service, the official website, or another appropriate method.
- Revised Terms will become effective when posted through the Service or official website, or at another time specified by the operator.
Article 17 (Governing Law and Jurisdiction)
- These Terms are governed by the laws of Japan.
- If a dispute arises between the operator and a user in connection with the Service, the parties will endeavor to resolve the dispute in good faith through discussion.
- If the dispute cannot be resolved through discussion, the matter will be subject to the jurisdiction of a competent court in Japan in accordance with applicable Japanese law.
